The obligation to forward data into the EESZT is implemented in three categories or modules. All healthcare providers connected to the EESZT with a reporting obligation are mandated to report the generated data and documents that are defined by law.

Please be aware that you need to have an EESZT accredited IT system in order to start reporting. Data reporting is conducted in an automated manner through the IT system. Therefore, connecting healthcare providers preparing for data reporting are first mandated to secure and use an EESZT accredited IT system.

Extending the range of data

Up until 31.10.2020, the following data were subject to the reporting obligation:

 

Central Event Catalogue:

Based on Appendix 1. of the Decree, outpatient and inpatient specialized care, general practitioner and pediatric care, computed tomography (CT) and magnetic resonance (MR) imaging, ambulance car care, ER event care and care related to it must be recorded as care events.

 

Medical Documents:

Based on Appendix 4. of the Decree: discharge summaries, outpatient medical reports, general laboratory results, microbiology laboratory results (optional), histology and pathology reports, other laboratory results (optional), CT and MR imaging reports, other imaging reports, surgical procedure reports, ambulance car reports and specialist referrals.

 

Medical profile:

The register related to the medical profile contains the data descriptive of the general health condition of the patient (e.g.: allergies, vaccination history, present illnesses, previous surgeries, lifestyle factors, etc.). The range of data that must be provided are defined by Appendix 3 of the Decree.

 

With effect from 31.10.2020, Decree No. 37/2020. (X. 30.) of the Ministry of Human Capacities amended the scope of the data subject to the reporting obligation, with the exception of eProfile, so that the following encounters and documents must also be recorded in the EESZT:

• Medical care of law enforcement and national defense personnel

 

Medical documents

• Documentation of prenatal care
• Documentation of postnatal care
• Documentation of infant and child care
• Coronary CT (CCTA) reports
• Surgical description of coronary intervention procedures
• Oncoteam report

 

Following the amendment of the Decree, providers will have 3 months to start fulfilling their reporting obligation to the EESZT regarding the extended range of data and documents, i.e. the preparatory phase ends on 31 January 2021. The developments necessary for the extended EESZT reporting obligation will be performed by your IT system provider, the healthcare provider needs only to ensure the recording of the data into the local informatics system.

1. Reimbursement of care events from the National Health Insurance Fund of Hungary (NEAK)

Based on Government Decree 154/2020 (IV. 27.), regarding the amendment of Government Decree 43/1999 (III. 3.) on issues of financing healthcare from the National Health Insurance Fund of Hungary, inpatient specialized care medical encounters may only be reimbursed from NEAK if they have been appropriately recorded and documented in the EESZT.

According to the amendment:

• the National Directorate General for Hospitals (OKFŐ), as the operating body of the EESZT, will monthly transfer the data to National Health Insurance Fund (NEAK) of Hungary of secondary and primary inpatient specialist care events of the previous month recorded in EESZT with the data content defined by relevant legislation,
• NEAK will verify that the data received are consistent with the events reported by inpatient care providers for reimbursement;
• and in case of a discrepancy, financing for said event will be rescinded.

EESZT will first provide data for NEAK for the month of April 2020. However, the withdrawal of financing will only be implemented after a month-long grace period, for reporting regarding May 2020. NEAK reimburses providers for inpatient care events based only on records in EESZT already, and this practice can be expected to be extended to other types of publicly funded care.

 

2. Supervision of EESZT registration and reporting obligation by the governmental health agency

On 1 June 2020, Government Decree 147/2020. (IV. 22.) regarding the general conditions for the exercise of healthcare and the operating licence authorisation procedure, and the amendment of Government Decree 96/2003. (VII. 15.) came into effect, which, among other things, will allow the governmental health agency to impose fines to the healthcare service provider or, in certain cases, to revoke its licence, if the EESZT connection and/or reporting obligations are neglected by the provider.

According to the amendment:

• following the 1^st of June 2020, a statement will have to be attached to the application for operating licences, stating that the provider will complete the connection to EESZT in 8 days after receiving permanent licence, and will continuously abide by its reporting obligation thereafter,
• the provider will be mandated to complete the connection to EESZT in 8 days after receiving permanent licence, and to continuously abide by its reporting obligation thereafter,
• the operating body of EESZT will regularly provide data for the National Public Health Centre (NNK) regarding the completion of connection and reporting obligations from the 1^st of June 2020,
• and the body issuing the licence will monitor the fulfilment of obligations by the provider from the 1^st of July 2020, and can impose fines or other legal sanctions if necessary (and can even revoke the operating licence of the provider).

In addition, it is mandatory to include in contributory contracts the responsibilities of the contributor within the EESZT reporting obligation in connection with the contributor’s work performed during the cooperation. Thus, in the case of contributory services, it will be clear for both parties, who is responsible for the fulfilment of the reporting obligation to the EESZT. According to the legislation, existing contracts had to be reviewed and modified until 1 September 2020.
